Terms of use.

You must be at least 18 years old to use the Site or to apply. By using the Site you represent that you are.

The Site describes a performance program and points you to an application. Nothing on the Site is an offer of work, a promise of work, or a guarantee of any role, income, rank, promotion or outcome. Selection is by application, and any engagement is subject to a separate written agreement that alone defines the relationship, including any independent-contractor relationship.

Using the Site or applying does not create an employment, contractor, agency or partnership relationship with Militia.

Compensation in any role is set out only in the written agreement for that role. The Site makes no representation about what any person has earned or will earn. Any description of pay structure, ranks or advancement on the Site is a description of how the program is organised, not a promise of results, and results vary with the individual, the market and the work.

Militia is a sales and performance organisation. The Site uses military imagery, including rendered firearms and night-vision equipment, as brand art. No firearm is used, issued or required in any role, and the imagery is not a description of the work.

The Site, its design, text, the MILITIA name and marks, the logo suite and the character art are owned by Militia or its licensors and are protected by intellectual-property law. You may view the Site for your own use. You may not copy, reproduce, distribute, modify or create derivative works from it, or use our name, marks or art, without our written permission.

Certain 3D models on the Site are used under Creative Commons licences and are credited on the Legal page. Their authors’ rights are theirs.

You agree not to:

• Use the Site for any unlawful purpose or in violation of the rights of others;
• Probe, scan or test the vulnerability of the Site, or circumvent its security;
• Scrape, crawl or copy the Site or its content other than through ordinary browsing or public search indexing;
• Introduce malware or interfere with the operation of the Site; or
• Misrepresent your affiliation with us, or use our name or marks to imply endorsement.

The Site links to third parties, including the Militia platform, the Militia store (hosted on Shopify), Instagram and LinkedIn. We are not responsible for their content, policies or practices, and your use of them is subject to their own terms. The Site is hosted and measured by third-party providers described in our Privacy Notice.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ACCURATE OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MILITIA MARKETING AND ITS AFFILIATES, OFFICERS, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Militia and its affiliates from any claims, damages, liabilities and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute arising from the Site.

We may update these Terms from time to time. The “Last updated” date at the top reflects the current version. Your continued use of the Site after an update means you accept the updated Terms.
